The USA EB-1 Visa: Priority Workers
The EB-1 visa is a category of U.S. employment-based immigrant visas reserved for "priority workers." These are individuals recognized for their extraordinary ability, outstanding professors and researchers, or multinational executives and managers. The EB-1 visa offers a significant advantage: visa availability is generally more favorable compared to other employment-based categories, meaning applicants may not have to wait as long for a visa number to become available.
EB-1 Visa Variants and Key Eligibility Criteria:
There are three subcategories within the EB-1 visa:
1. EB-1A: Extraordinary Ability
- Receipt of lesser nationally or internationally recognized prizes or awards for excellence.
- Membership in associations in the field which demand outstanding achievements of their members.
- Published material about the person in professional or major trade publications or other major media.
- Evidence of participation, either individually or on a panel, as a judge of the work of others in the same or an allied field.
- Evidence of original scientific, scholarly, artistic, athletic, or business-related contributions of major significance to the field.
- Evidence of authorship of scholarly articles in professional or major trade journals or other major media.
- Evidence that the person has performed in a leading or critical role for distinguished organizations.
- Evidence that the person has commanded a high salary or other significantly high remuneration for services, in relation to others in the field.
- Evidence of commercial successes in the performing arts.
3. EB-1B: Outstanding Professors and Researchers
- A tenured position (or tenure-track position) at a university or institution of higher education to teach in the academic field, or
- A comparable position at a university or institution of higher education to conduct research in the field, or
- A position to conduct research in the field, if the department, division, or institute of the private employer employs at least three persons full-time in research activities and the employer has documented accomplishments in an academic field.
